Customer Service Policy:

MUTUAL EDUCATIONAL LOAN AGREEMENT

This Mutual Educational Loan Agreement, hereinafter referred to as the “Agreement,” is entered into as of the date of purchase or enrollment, hereinafter referred to as the “Effective Date,” by and between the undersigned customer, parent, guardian, or family, hereinafter referred to as the “Family,” and Arnold Jagt, hereinafter referred to as the “Educational Provider.”

1. Nature of the Agreement

The parties acknowledge that the Educational Provider’s work is structured as a mutual loan arrangement.

Under this arrangement, the Educational Provider loans to the Family certain educational products, materials, access rights, services, and support, hereinafter collectively referred to as the “Educational Resources.”

In exchange, the Family loans to the Educational Provider the amount paid at the time of purchase or enrollment, hereinafter referred to as the “Loan Amount.”

The parties intend this arrangement to support the continued availability, maintenance, improvement, and support of the Educational Resources for the benefit of participating families.

2. Educational Resources Loaned to the Family

The Educational Provider agrees to make available to the Family the educational products, curriculum materials, digital access, services, and/or support associated with the Family’s selected purchase or enrollment.

These Educational Resources are loaned to the Family for their educational use, subject to any accompanying instructions, guidelines, access terms, or limitations provided by the Educational Provider.

The Educational Provider warrants that the Educational Resources provided to the Family are, to the best of the Educational Provider’s knowledge, functional and free from material defects at the time they are initially made available.

3. Money Loaned to the Educational Provider

The Family agrees to loan to the Educational Provider the amount paid by the Family in connection with the selected Educational Resources.

This amount shall constitute the “Loan Amount” under this Agreement.

The Loan Amount is provided in consideration of the Educational Provider’s loan of Educational Resources to the Family and the Educational Provider’s ongoing efforts to maintain, support, and improve those Educational Resources.

4. Interest Rate

The Loan Amount shall bear interest at the rate of zero percent per annum.

No interest shall accrue or be payable by the Educational Provider to the Family during the term of this Agreement.

Likewise, no interest shall accrue or be payable by the Family to the Educational Provider for the use of the Educational Resources.

5. Term of Agreement

This Agreement shall remain in effect for as long as the Educational Provider continues to make the applicable Educational Resources and reasonable support available to the Family.

The parties acknowledge that the Educational Provider’s ongoing support may include reasonable assistance, maintenance, updates, access support, technical support, customer service, or other efforts related to the continued usability of the Educational Resources.

6. Repayment Upon Cessation of Support

If the Educational Provider permanently ceases to provide the Educational Resources or reasonable support associated with them, the Family may request repayment of the Loan Amount.

Before requesting repayment, the Family shall notify the Educational Provider in writing of the perceived cessation of support or access and shall provide the Educational Provider a reasonable opportunity to cure the issue.

If the Educational Provider does not cure the issue within a reasonable time, the Family may request repayment of the Loan Amount.

Upon a valid repayment request under this section, the Educational Provider shall repay the Loan Amount to the Family within thirty days, without interest, penalty, or additional fees.

7. Conditions of Support Cessation

For purposes of this Agreement, “cessation of support” means a substantial and continuing failure by the Educational Provider to make the applicable Educational Resources or reasonable support available to the Family.

Temporary interruptions, technical difficulties, scheduled maintenance, changes in delivery method, updates to systems or materials, or interruptions beyond the Educational Provider’s reasonable control shall not constitute cessation of support, provided the Educational Provider makes reasonable efforts to restore access or support.

8. Proper Use of Educational Resources

The Family agrees to use the Educational Resources in accordance with any instructions, guidelines, access rules, or limitations provided by the Educational Provider.

The Educational Provider’s warranty and support obligations are contingent upon proper use of the Educational Resources by the Family.

The Family shall not misuse, redistribute, resell, reproduce, or otherwise transfer the Educational Resources except as expressly permitted by the Educational Provider.

9. No Interest, Fees, or Penalties

This Agreement does not create any obligation for either party to pay interest, finance charges, late fees, penalties, or additional compensation beyond the terms stated herein.

The parties acknowledge that the purpose of this Agreement is educational cooperation and continued support, not the creation of a commercial lending arrangement bearing interest.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Educational Provider conducts business, without regard to conflict-of-law principles.

11. Entire Agreement

This Agreement constitutes the entire understanding between the Family and the Educational Provider with respect to the subject matter herein and supersedes all prior agreements, negotiations, or understandings, whether written or oral, concerning the same subject matter.

12. Acceptance of Agreement

The parties acknowledge their acceptance of this Agreement by the Family’s payment of the Loan Amount and the Educational Provider’s provision of the Educational Resources.

The Family may print and sign this Agreement for its records.
